Friend or Relative Not Returning Money? How to Recover a Loan Without a Written Agreement
In our day to day life we all support our friends and relatives by helping them with cash money. we had seen it from our childhood that its on promise that our Bua or Uncle or even a family friend will take money and return . But sometimes we see people who take money and forget , months even years they donot care for it and when you ask for it they make lame excuses and sometimes even refuse and donot accept the facct that they had taken then money, they know its cash or even its through UPI or bank transation , they think there is no need to return because there was no paper work or a written agreement on it . A question comes in mind , Can you still recover money lent without agreement? In most cases, yes. Indian law does not require a loan to be in writing. What decides your case is proof and time.
This guide explains what counts as proof, the deadline you cannot miss, and the exact steps — from a polite reminder to a recovery suit in court.
| Quick answer
A loan given without a written agreement is still a valid, enforceable contract. To recover it: • Collect proof — bank or UPI transfers, chats, emails, witnesses or even whtsapp chat and reminders. • Try to get a written acknowledgment of the debt from the borrower. • Send a legal notice through an advocate with a clear deadline. • File a money recovery suit in the civil court if they still do not pay. Act within 3 years of giving the loan (or of the borrower’s last written acknowledgment or part-payment). After that, the court case is usually time-barred. |
Is a loan without a written agreement legally valid?
Yes. Under the Indian Contract Act, 1872, an agreement made with free consent, for a lawful purpose and with something in return is a contract — whether it is spoken or written. A friendly loan is a promise to repay, and that promise can be enforced in court.
The clear difference is that a written agreement has an evidence, not validity. Without one, you have to show the court three things: that the money was paid, that it was a loan (not a gift or a business investment), and that it has not been repaid. Means with a written agreement you have evidence and its easy to prove and without a written agreement you had to establish the intension and situation that the transation was a loan and it was lent with verbal promise to repay.
What counts as proof of the loan
| Evidence | Strength | Tip |
| Bank transfer, UPI or cheque payment to the borrower | Strong | Download statements now; note the date, amount and reference number |
| Messages or emails where the borrower admits the loan or promises to repay | Strong | Export the full chat, not screenshots alone; keep the phone safe |
| Cheque or promissory note given by the borrower | Very strong | A bounced cheque also opens a separate route — see below |
| Part-payments received back from the borrower | Strong | Shows the money was a loan, not a gift |
| Witnesses who were present or knew about the loan | Moderate | Write down names and what they know while memories are fresh |
| Cash given with no record | Weak | Look for cash-withdrawal records, messages around the date and witnesses |
Cash loans are the hardest to prove — and income tax law restricts taking or repaying loans of Rs 20,000 or more in cash. Use bank transfers for any future loan.

A three-judge bench of the Supreme Court held that a certificate about the electronic record is required when electronic evidence (emails, chats, digital statements) is produced in court through a copy, rather than the original device. This was earlier Section 65B of the Evidence Act; the equivalent rule is now Section 63 of the Bharatiya Sakshya Adhiniyam, 2023. What it means for you: WhatsApp chats and emails are valid evidence — preserve the original phone or account so the certificate can be given. |
The deadline: 3 years — and how it can be extended
Under the Limitation Act, 1963, a suit to recover money lent must generally be filed within 3 years from the date the loan was given (Articles 19 and 21). Miss it, and the court will usually dismiss the case even if the debt is real.
The clock restarts in two situations:
- Written acknowledgment (Section 18): if, before the 3 years end, the borrower acknowledges the debt in writing and signs it, a fresh 3-year period starts from that date. Courts have in some cases accepted emails and messages as acknowledgments, but a signed letter is safest.
- Part-payment (Section 19): a part-payment made before the 3 years end restarts the period, provided the payment is recorded in the borrower’s own handwriting or in a writing signed by them.
Practical tip: a polite message such as “Please confirm you will return the Rs xxxxx I lent/gave you in xx month year” — answered with “Yes, I’ll return it by xxx time” — can become valuable evidence. Never fake or alter any message.
Step-by-step: how to recover money lent without agreement
Step 1 — Organise your evidence
Prepare a one-page timeline: date of each payment, amount, mode, any promise to repay, and any money received back. Attach statements and exported chats.
Step 2 — Ask in writing first
Send a calm, written request by WhatsApp or email asking for repayment by a specific date. Keep it factual and polite. It often brings either payment, a repayment plan or a written admission.
Step 3 — Send a legal notice
A legal notice from an advocate sets out the loan, your proof and a deadline (commonly 15 days), and warns of legal action with interest and costs. Many borrowers pay or offer instalments at this stage. If they reply denying the loan, that reply also helps your advocate plan the case.
Step 4 — Try mediation or Lok Adalat
Pre-litigation mediation and Lok Adalats run by the Delhi legal services authorities can settle money disputes quickly and cheaply. An agreed settlement in a Lok Adalat is final and can be enforced like a court decree.
Step 5 — File a money recovery suit
If nothing works, your advocate files a civil suit for recovery of the amount, with interest and costs, in the court where the borrower lives or where the loan was given or was to be repaid (Section 20, Code of Civil Procedure). Court fee in Delhi depends on the amount claimed.
Which kind of suit? A faster summary suit (Order XXXVII, CPC) is available only when the claim rests on a written document — such as a promissory note, a cheque, or a written contract. Where there is truly nothing in writing, an ordinary recovery suit is filed, where you prove the loan through bank records, chats and witnesses.
Step 6 — Execute the decree
Winning the case gives you a decree. If the borrower still does not pay, the court can attach their bank account, salary or property in execution proceedings.
If the borrower gave you a cheque
If the borrower handed you a cheque for the loan and it bounced, you may also have a criminal remedy under Section 138 of the Negotiable Instruments Act — but its deadlines are very short (a legal notice within 30 days of the bank’s return memo). Read our detailed cheque bounce guide [insert internal link] and speak to an advocate the same week the cheque returns.
Can I file a police complaint for cheating?
Usually not, if the person simply has not repaid. Not returning a loan is a civil dispute. A criminal case for cheating (Section 318, Bharatiya Nyaya Sanhita) fits only where the borrower intended to deceive you at the time they took the money — for example, a false story, a fake identity, or a pattern of taking money from several people with no intention to repay.
| Case law: Lalit Chaturvedi v. State of Uttar Pradesh (2024)
The Supreme Court quashed criminal proceedings for cheating and criminal breach of trust that arose out of unpaid money, observing that non-payment of money is a civil wrong to be pursued in a civil court, and that criminal law should not be used to pressure someone into paying a civil debt. |
| Mistakes that can hurt your case
• Waiting too long — the 3-year limit is strict. • Deleting chats or changing phones without backing up the conversation. • Threatening, abusing or publicly shaming the borrower on social media — it can expose you to criminal and defamation complaints. • Taking their belongings or vehicle to “settle” the debt. • Filing a false cheating FIR to pressure them — courts take a serious view of this. • Regular lending at interest as a business — if you lend to many people for interest, Delhi’s money-lending registration law may apply; a one-off friendly loan is different. |
| Living abroad? You can recover the money without coming to India
• Your Indian advocate can send the legal notice on your instructions by email and video call. • Give a specific power of attorney to a trusted person in India who knows the facts, so they can file and follow the case. Sign it at the Indian consulate, or notarise and apostille it abroad, then get it stamped in India within three months. • Your bank statements from abroad and international transfer records (SWIFT advice) are valid proof. • Courts can record your evidence by video conference or through a commission, so travel is often not needed. |
Frequently asked questions
Can I recover money lent without agreement in India?
Yes. An oral loan is a valid contract. You need to prove the payment, that it was a loan and that it is unpaid — through bank records, messages, part-payments and witnesses.
Is a WhatsApp chat valid proof of a loan?
Yes. Chats and emails are electronic evidence. Keep the original phone or account safe, because a certificate is needed when a copy is produced in court.
What is the time limit to recover a loan given to a friend?
Generally 3 years from the date of the loan. A signed written acknowledgment or a recorded part-payment before that date starts a fresh 3-year period.
Can I claim interest if we never agreed on interest?
You can ask for it. The court has discretion to award reasonable interest, especially from the date of the suit.
Will the police help me get my money back?
Usually not, because non-repayment is a civil matter. Police act only if there was cheating or fraud from the start.
How do I prove a cash loan?
It is difficult. Use cash-withdrawal records around the date, messages that mention the amount, part-payments and witnesses. Avoid cash for future loans.
Do I need a lawyer to send a legal notice?
It is not mandatory, but a notice from an advocate is taken more seriously and is drafted with the later court case in mind.
What should I do first before filing a court case?
Send a formal Legal Notice to the borrower through a lawyer giving them a specific timeframe (usually 15 days) to repay the money. Most disputes are resolved at this stage without going to court.
Which court procedure is the fastest for recovering money?
Filing a Summary Suit (under Order 37 of the Civil Procedure Code) is usually the fastest method. Unlike regular suits, the borrower cannot defend the case automatically and must seek special permission from the court to present a defense.
Can I file a case if the borrower gave me a cheque that bounced?
Yes. You can file a criminal complaint under Section 138 of the Negotiable Instruments Act, provided you issue a legal notice within 30 days of the cheque bouncing and the borrower fails to pay within 15 days of receiving the notice.
What if the borrower has moved to another city or state?
You can generally file the case in the city where you transferred the money (where your bank account is located) or where the borrower currently resides or works.
Can I recover money from the legal heirs if the borrower passes away?
Yes, but only up to the value of the property or assets the legal heirs inherited from the deceased borrower. They are not personally liable beyond what they inherited.
What if the borrower refuses to accept or sign for the Legal Notice?
If a legal notice is sent by Registered Post AD to the borrower’s correct address and comes back “refused” or “unclaimed,” Indian courts consider it as legally delivered (deemed service).
Can I charge criminal charges like cheating (Section 420 IPC / Section 318 BNS) for non-payment?
Only if you can prove that the borrower had dishonest intentions from the very beginning (e.g., they used fake identity documents, gave a fake cheque, or lied about a non-existent emergency). Simple inability to repay later is not considered criminal cheating.
Are voice recordings or phone call logs valid legal evidence?
Yes, audio recordings of phone conversations acknowledging the debt are admissible as electronic evidence, provided you retain the original recording device and present a Certificate under Section 65B of the Indian Evidence Act (now Section 63 of the Bharatiya Sakshya Adhiniyam).
