Meaning of Maintenance

Maintenance is the financial support provided to a person who is unable to sustain themselves, ensuring basic needs such as food, clothing, shelter, and dignity. Indian law recognizes maintenance primarily in the context of family relationships, including spouses, children, and parents.


Maintenance under Section 125 CrPC

Section 125 of the Code of Criminal Procedure, 1973 empowers a Magistrate to provide prompt maintenance to dependents who cannot support themselves. Key Features:
  • Eligible Dependents: Wife (including certain divorced wives), minor or dependent children, and parents unable to maintain themselves.
  • Persons Liable: Husband for wife/children; children for parents if capable.
  • Procedure: The dependent applies to the Magistrate, who may order a monthly allowance.
  • Factors for Determining Amount: Financial capacity of the liable person, needs of the dependent, and standard of living.
  • Purpose: Prevents destitution and protects the dependent’s dignity; failure to comply can attract criminal penalties under Section 125 CrPC.
